Mozambique Employer's Guide

Mozambique, a Southeast African nation with a coastline stretching along the Indian Ocean, is experiencing robust economic growth driven by its abundant natural resources, particularly in the energy and mining sectors. This economic expansion has created employment opportunities but also presents unique challenges for employers.

Mozambique's tax system comprises direct and indirect taxes levied at national and municipal levels. Individuals are taxed on worldwide income if resident, and non-residents on Mozambique-sourced income at a flat 20%. Corporate income tax is 32% for residents and non-residents with a permanent establishment, while non-residents without face withholding taxes. Consumption is taxed through VAT, excise duties, and customs duties. Additional taxes include stamp duties, property transfer taxes, and municipal taxes on real estate and economic activities. The system, while modern, is relatively new, with specific provisions for the growing extractive industry. Mozambique has tax treaties with several countries to prevent double taxation.

Sector-specific minimum wages might apply in certain industries. For example, specific categories in the fishing sector are at 5,000 MZN while financial services and insurance companies are at about 18,000 MZN. However, it's essential to note that the cost of living is also generally lower.

Standard working hours in Mozambique are 40 to 48 hours per week, distributed over six days. Overtime limits and compensation are legislated for and calcuated using various factors including employee pay structure, e.g., hourly, salaried, iecework, and commission

While not mandated by law, formal sector employees receive at least one additional benefit from their employers. Common benefits include:

Housing allowances
Transportation subsidies
Private health insurance
Meal vouchers or subsidie

Mozambican labor law provides for the following types of leave:

Annual leave
A minimum of 1 day per month in first year of service, a minimum of 2 days per month in second year of service, and 30 days per year thereafter.

Sick leave
Duration varies based on the nature of the illness and the employee's length of service, however employees are entitled to 15 days paid sick leave per year and up to 5 days consecutive sick leave per quarter.

Maternity leave
Labour law grants 90 days materinity leave. 60 days of maternity leave is covered by social security and additional 30 days unpaid leave is granted (unless a payment arrangements are negotiated).

Paternity leave
7 days of unpaid paternity leave are granted.

Public holidays
Mozambique observes 11 national holiday days in the year.

Mozambique's workforce is predominantly young and eager to learn. To attract and retain talent, employers should consider the following strategies:

Competitive compensation packages
Offering salaries and benefits that align with market standards.

Training and development opportunities
Investing in employee skills and career growth.

Opportunities for advancement
Creating clear career paths within the organisation.

Work-life balance initiatives
Promoting employee well-being and job satisfaction.

Mozambique's labor laws regulate the termination of employment. Unfair dismissal is prohibited, and employers must adhere to specific procedures, including notice periods and severance pay.

Employers in Mozambique have access to a range of long-term and temporary options for ensuring compliant employments in-country. These include but are not limited to agency, in-country partner, PEO, and EOR arrangements.
